Terms of Service

Welcome to Space Pick ("Platform," "we," "us," or "our").
Space Pick is a booking platform that enables users to reserve and manage space rentals for various activities, including but not limited to indoor sports facilities, event spaces, and recreational areas.

These Terms of Service (“Terms”) govern your use of the Platform operated by Borderless Tech Limited
By accessing or using the Platform in Hong Kong, you agree to be bound by these Terms and our Privacy Policy.

Eligibility

You must be 18 or older to use the Platform.

Privacy

We comply with the Personal Data (Privacy) Ordinance (Cap. 486) and our Privacy Policy.

Currency & Payments

All payments are in Hong Kong Dollars (HKD) and processed securely by Stripe Payments Hong Kong Limited (“Stripe”). Prices are inclusive of any applicable taxes unless stated otherwise. By making a booking, you authorise Stripe to charge your chosen payment method.

Cancellation and Refund Policy

(a) For Rental Users (customers renting spaces)
Cancellation and refund terms are determined solely by the Merchant and are clearly displayed before payment confirmation. Where a refund is granted under the Merchant’s policy, it will be processed via Stripe within 5–10 business days.

(b) For Merchants (venue owners / subscribers)
All subscription fees, listing fees, commissions, and any other charges payable by Merchants to Space Pick are strictly non-refundable except where required by applicable law. Fees are charged for the full committed subscription term; no pro-rata or partial refunds will be given for early termination, suspension, or cancellation of a Merchant account.

User Responsibilities

You must comply with all Merchant rules and all applicable Hong Kong laws.

Intellectual Property

All content on the Platform, including logos, designs, text, and software, is owned by us or our licensors. You are granted a limited, non-exclusive license to use the Platform for its intended purpose only. You may not copy, modify, or distribute any content without our written permission.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) Our total liability to you for all claims arising from or relating to the Platform shall not exceed the total amount you have actually paid to us through the Platform in the 12 months preceding the event giving rise to the claim.
(b) In no event shall we be liable for any indirect, consequential, incidental, special, or punitive damages, including lost profits, revenue, or data.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute shall be submitted to the non-exclusive jurisdiction of the courts of Hong Kong.

General Provisions

We may amend these Terms at any time. Continued use after amendment constitutes acceptance.
